Terms of Service
Lire en françaisLast updated
In short
- You own what you generate. We do not train on it.
- Paid plans renew until you cancel; cancelling takes effect at the end of the period you already paid for.
- If you are a consumer, you have 14 days to withdraw — and we do not make you sign that right away just by using the product.
- There is a hard line on what you may generate: no CSAM, no non-consensual deepfakes of real people, no fraud.
- French law applies, and a consumer mediator is available free of charge before any court.
This summary is here to be read. It is not a substitute for the text below, which is what actually governs.
1. Who you are contracting with
These terms form the contract between you and Flashly Studio, whose full legal identity, registration number and registered address are on the Legal Notice page.
By creating an account or using the service you accept these terms and our Privacy Policy. If you do not accept them, do not use the service.
If you are entering into this contract for a company, you confirm that you are authorised to bind it.
2. What the service is
Flashly is a platform for generating, editing and managing images and video using artificial intelligence.
You should understand three things about how it works before you rely on it:
- Outputs are probabilistic. The same prompt can produce different results. Outputs may contain artefacts, inaccuracies, or details you did not ask for.
- We route between third-party models. Which model renders your request is our decision and can change without notice, as models are released and retired.
- The service evolves. We add, change and remove features. We will not remove a feature that is central to a paid plan without telling subscribers first.
Review every output before you publish it. You are responsible for what you put into the world under your own name.
3. Your account
- You must be at least 16 years old.
- You are responsible for keeping your credentials confidential and for what happens under your account.
- One human per account. You may not share credentials; team members get their own seats.
- Tell us at security@flashlystudio.com immediately if you think someone else has access.
4. What you may not generate
This is the part of these terms we enforce most strictly. You may not use Flashly to produce:
- Child sexual abuse material, or any content sexualising a minor. Accounts are terminated immediately and reported to the competent authorities. There is no warning and no refund.
- Sexual or intimate imagery of a real, identifiable person without their consent, including "nudify" style edits.
- Deepfakes impersonating a real person — their face, voice or likeness — in a way designed to mislead, including of public figures.
- Content infringing someone else's intellectual property, image rights or privacy.
- Fraudulent documents: identity papers, banknotes, official seals, certificates, invoices.
- Electoral disinformation, or content presenting itself as authoritative medical, legal or financial advice.
- Content that is illegal, defamatory, harassing or hateful, or that incites violence or terrorism.
- Anything for a purpose prohibited by Article 5 of the EU AI Act, including social scoring and untargeted scraping of facial images to build recognition databases.
You also may not attempt to bypass safety filters, reverse-engineer the service, resell raw model access, or scrape the platform at scale.
We may suspend or terminate an account that breaks these rules. For serious breaches we do so without notice and without refund; for everything else we will tell you what happened and give you a chance to respond.
Reporting illegal content
If you believe content hosted on Flashly is illegal, email legal@flashlystudio.com with a link and an explanation. We will assess it promptly, act where the report is well-founded, and tell you what we decided. If we remove your content, we tell you why and you can contest the decision at the same address.
5. Your content, and who owns what
You keep ownership of what you upload. You grant us a limited, worldwide, royalty-free licence to store, process and transmit it — solely to run the service for you. That licence ends when you delete the content, and it covers nothing else. We do not use it to promote Flashly without asking you first.
As between you and us, you own the outputs you generate, subject to:
- these terms and the rules in section 4;
- any restriction imposed by the third-party model that rendered it, and
- the fact that we cannot grant what nobody owns.
Two honest caveats:
- Exclusivity is not guaranteed. Generative models can return near-identical results to different users from similar prompts.
- Copyright in purely AI-generated output is unsettled in France, the EU and elsewhere. Courts have generally required human creative input for protection to arise. We cannot promise that a given output is protectable, and we do not warrant that it does not resemble an existing work.
We never use your prompts, uploads or outputs to train, fine-tune or evaluate any AI model. See the Privacy Policy for the full commitment.
6. AI transparency
Article 50 of the EU AI Act (Regulation (EU) 2024/1689) requires synthetic image, audio and video to be marked in a machine-readable way as artificially generated. Outputs you download may therefore carry provenance metadata. You must not strip that marking in order to pass an output off as an authentic recording of real events, and if you publish a deepfake of a real person or place you have your own disclosure obligation under the same article.
7. Prices, billing and renewal
- Prices are displayed in US dollars on the pricing page and charged in that currency. Your bank may apply a conversion fee we neither set nor receive.
- Flashly is operated by a French micro-entreprise under the VAT exemption scheme: VAT is not applicable, art. 293 B of the French General Tax Code. Invoices show no VAT and none can be reclaimed.
- Paid plans are billed in advance, monthly or annually, through Stripe, and renew automatically until cancelled.
- Cancel any time from Account → Manage subscription. Cancellation takes effect at the end of the period you have already paid for; you keep access until then.
- Deleting your account cancels your subscription immediately and stops any further charge.
- Unused credits expire at the end of the billing period and are not carried over or refunded on downgrade.
- If a payment fails we will retry and email you. Access may be suspended until it succeeds.
- We may change prices with at least 30 days' notice by email. A change never applies to a period you have already paid for. If you do not accept a new price, cancel before it takes effect.
8. If you are a consumer: your right to withdraw
This section applies if you are contracting outside your trade or profession. It sets out rights that the law gives you and that we cannot reduce.
You have 14 days from the day your paid subscription starts to withdraw, with no reason and no penalty. Email billing@flashlystudio.com, or use the withdrawal form, and we will confirm.
Because a subscription is useless if it only starts two weeks later, you can ask us to begin immediately. If you do:
- You keep your right to withdraw. You pay only a proportionate amount for what you actually used up to the moment you told us, and we refund the rest within 14 days (French Consumer Code, art. L.221-25).
- The exception is digital content you have already generated and downloaded. For those specific files, the right to withdraw is lost once supply has begun with your express prior consent and your acknowledgment of that loss (art. L.221-28, 13°). It does not extinguish your right over the rest of the subscription.
Full detail, and the standard withdrawal form, are on the Refund & Withdrawal Policy page.
9. Legal guarantee of conformity
As a consumer you benefit from the legal guarantee of conformity for digital content and services (French Consumer Code, art. L.224-25-1 and following, transposing Directive (EU) 2019/770). If the service does not conform to what was promised, you may require it to be brought into conformity, and failing that obtain a price reduction or terminate the contract. This guarantee applies for the whole duration of supply, is free, and exists independently of any commercial gesture we might make.
Nothing in these terms limits it.
10. Availability
We aim to keep Flashly available, but we do not commit to a service level on self-serve plans. Maintenance, third-party model outages and force majeure happen. Enterprise customers may have an SLA in a separate signed agreement, which prevails over this section.
11. Disclaimers and liability
To the maximum extent the law allows, the service is provided as is, and we exclude implied warranties of merchantability and fitness for a particular purpose. AI outputs may be inaccurate, biased or unsuitable; verifying them is your job.
Our total liability arising from the service is limited to the greater of (a) what you paid us in the 12 months before the claim, or (b) EUR 100. We are not liable for indirect or consequential loss, lost profit, lost data or lost opportunity.
These limits do not apply, and nothing in these terms excludes our liability, for death or personal injury, fraud or fraudulent misrepresentation, gross negligence or wilful misconduct, or anything else that French law does not permit us to exclude — including a consumer's rights under section 9.
12. Indemnity
If you are using Flashly in the course of a business, you will indemnify us against third-party claims arising from content you submitted or generated, your breach of these terms, or your infringement of someone else's rights. This does not apply to consumers.
13. Ending the contract
You may delete your account at any time from Account Settings. We may terminate for material breach of these terms, with notice where it is reasonable to give it, and immediately for the conduct in section 4.
On termination we delete your content under the retention schedule in the Privacy Policy. Export anything you want to keep before you delete your account — we cannot recover it afterwards.
14. Changes to these terms
We may update these terms. Material changes are emailed to active users at least 30 days before they take effect. If you do not accept them, cancel before the effective date; continuing to use the service afterwards means you accept them.
15. Governing law, mediation and courts
These terms are governed by French law.
If you are a consumer, you must be offered mediation before litigation. You may refer any unresolved dispute, free of charge, to our consumer mediator — named on the Legal Notice page — after first having tried to resolve it with us in writing (French Consumer Code, art. L.612-1 and following).
Please note that the European Commission's Online Dispute Resolution platform closed on 20 July 2025 and no longer accepts complaints. Any link to it in older terms, ours or anyone else's, is dead.
As a consumer you may also bring proceedings in the courts of your own place of residence. Otherwise, and for business customers, the courts of Paris have exclusive jurisdiction.
